Stocksy does not accept AI-generated content. This includes illustrations, photos, videos, or animations created or manipulated using generative AI tools such as Midjourney, DALL·E, Firefly, Runway, or AI-powered features in editing software like Photoshop or Lightroom.
We also do not allow the use of generative AI tools for editing, including removing logos or objects with features like Generative Fill.
Additionally, we don't accept AI-generated images used as props (e.g., framed art, magazine covers, apps, graphs, video games), since you won't be able to attach a valid property release.
Why?
From a legal standpoint, the US Copyright Office does not currently recognize artwork produced using generative AI as protectable by copyright. Unless and until that position changes, uploading AI-generated content would breach your Stocksy member agreement, which requires you to own the copyright to everything you upload. It would also violate the promises we make to clients in our license agreements regarding ownership of rights.
Even generative AI editing tools present risks, as they often leave detectable traces, such as via Content Credentials. If a client uses your content and it's flagged as "Made with AI," it could damage their trust in Stocksy.
What can I use for editing?
You are welcome to use traditional retouching tools such as:
- Patch
- Clone
- Healing brush
- Content-Aware Fill (as long as it samples from your image and doesn't generate new pixels)
- Photoshop's Remove Tool or Lightroom's Healing tools, if the generative AI setting is turned off
If you're unsure whether a tool uses generative AI, it's best to err on the side of caution or consult the tool's documentation.
Why did an editor ask if I used AI?
Neither AI detection tools nor human review is infallible. If we send your file back to ask about AI editing, it's likely because we noticed visible signs of manipulation at 100% zoom, which can occur even with traditional editing. If you used AI, you’ll need to re-edit the file. If not, reply to our email to confirm which tools you used.
Will you change your mind on this?
AI is a rapidly evolving issue, and our teams are closely monitoring legal, ethical, and client-related developments. Global copyright laws regarding AI-generated and AI-assisted content are still evolving, and we are taking a cautious approach as these decisions unfold. We will update the community if and when the legal landscape changes.
